Terms of Use

1. Acceptance of Terms

These Terms of Use ("Terms") constitute a legally binding agreement between you ("User", "Borrower", "you", or "your") and KASHJET Technologies Private Limited ("KASHJET", "Company", "we", "our", or "us"), a company incorporated under the laws of India, with its registered office at 302, Sahyog B, Goyal Nagar, Indore, Madhya Pradesh 452016.

By registering on, accessing, browsing, or using the KASHJET platform — including our website (www.kashjet.in), mobile application, APIs, and related services (collectively, the "Platform") — you acknowledge that you have read, understood, and agree to be bound by these Terms, our Privacy Policy, and all applicable laws and regulations.

If you do not agree with any part of these Terms, you must immediately discontinue use of the Platform. We reserve the right to modify these Terms at any time. Material changes will be communicated via email or in-app notification at least 15 days before taking effect.

2. Definitions

  • "Account" means the registered user account created on the Platform by providing verified personal and financial information.
  • "Credit Facility" or "Loan" means the short-term unsecured credit extended to a Borrower by an NBFC Partner through the Platform.
  • "Disbursement" means the transfer of approved loan funds to the Borrower's verified bank account.
  • "EMI" (Equated Monthly Installment) means the fixed monthly payment comprising principal and interest that the Borrower is obligated to pay.
  • "KYC" (Know Your Customer) means the identity and address verification process mandated by the Reserve Bank of India.
  • "Lending Partner" or "NBFC Partner" means the Reserve Bank of India (RBI) registered Non-Banking Financial Company or Bank that sanctions, processes, and disburses the Credit Facility.
  • "LSP" (Lending Service Provider) means KASHJET in its capacity as a technology platform facilitating loan origination and servicing on behalf of NBFC Partners.
  • "Platform" means the KASHJET website, mobile application, APIs, and all associated technology services.
  • "Processing Fee" means the one-time fee charged at the time of loan disbursement, as disclosed in the loan agreement.

3. Eligibility Criteria

To use the Platform and apply for a Credit Facility, you must satisfy all of the following conditions:

3.1 Mandatory Requirements

  • You must be a citizen and resident of India
  • You must be at least 18 years of age at the time of application
  • You must possess a valid PAN (Permanent Account Number) card
  • You must possess a valid Aadhaar card linked to an active mobile number
  • You must have an active bank account in your name with any scheduled commercial bank in India
  • You must have a verifiable source of income (salaried, self-employed, gig worker, or freelancer)
  • You must have an active Indian mobile number for OTP-based verification

3.2 Disqualifying Conditions

  • Individuals declared as willful defaulters by any financial institution
  • Individuals with an active insolvency or bankruptcy proceeding
  • Individuals on any government watchlist, sanctions list, or CERSAI registry for fraud
  • Non-resident Indians (NRIs) and foreign nationals
  • Individuals with CIBIL score below 550 (subject to NBFC Partner discretion)

4. Platform Services

KASHJET operates as a Lending Service Provider (LSP) — a technology platform that connects borrowers with RBI-registered NBFC Partners. KASHJET itself does not lend money, and does not hold an NBFC or banking licence.

4.1 Services Provided by KASHJET

  • User onboarding, registration, and digital KYC verification
  • Loan eligibility assessment and pre-qualification
  • Loan application submission and processing facilitation
  • Interest rate and EMI calculation tools
  • Loan disbursement tracking and status updates
  • Repayment schedule management and EMI payment facilitation
  • Customer support and query resolution
  • Credit score monitoring and financial literacy resources

4.2 Services Provided by NBFC Partners

  • Final credit assessment, underwriting, and loan sanction/rejection decisions
  • Determination of interest rates, processing fees, and other charges
  • Loan disbursement from the NBFC's own funds
  • Issuance of loan agreements, sanction letters, and regulatory disclosures
  • Regulatory reporting to credit bureaus and the Reserve Bank of India

5. Loan Terms & Conditions

5.1 Loan Parameters

  • Loan Amount: ₹2,000 to ₹2,00,000 (subject to eligibility and NBFC Partner approval)
  • Loan Tenure: 7 days to 180 days (varies by product and NBFC Partner)
  • Annual Interest Rate: 12% to 36% per annum (varies by borrower profile and risk assessment)
  • Processing Fee: 1% to 5% of the sanctioned loan amount (deducted at disbursement)
  • GST: 18% GST applicable on processing fees and other service charges
  • Prepayment: Borrowers may prepay the loan in full without any prepayment penalty, as per RBI guidelines

5.2 Disbursement

  • Approved loans are disbursed directly to the Borrower's verified bank account via NEFT/IMPS/UPI
  • Disbursement is subject to successful completion of KYC, e-mandate registration, and loan agreement execution
  • Typical disbursement time is under 30 minutes from final approval, subject to banking hours and system availability
  • KASHJET and its NBFC Partners reserve the right to delay or cancel disbursement if fraud or misrepresentation is detected

5.3 Repayment

  • Repayments are due on the dates specified in your loan agreement and repayment schedule
  • Payments are collected via e-NACH mandate, UPI AutoPay, or manual payment through the Platform
  • A grace period of 3 calendar days is provided after the due date before late payment charges are applied
  • Late payment charges: ₹50 per day or 2% of the outstanding amount per month (whichever is higher), subject to NBFC Partner policy
  • Failure to repay may result in reporting to credit bureaus (CIBIL, Experian, Equifax, CRIF High Mark), which will negatively impact your credit score
  • Persistent default may lead to legal recovery proceedings as per applicable law

5.4 Cooling-Off Period

  • As per RBI Digital Lending Guidelines 2022, borrowers have the right to exit a digital loan within a cooling-off period of 3 days from the date of disbursement
  • During this period, the borrower may return the entire loan amount without any penalty. Only proportionate interest for the days of usage and applicable taxes will be charged

6. User Obligations & Responsibilities

By using the Platform, you agree to the following obligations:

6.1 Account Security

  • You are responsible for maintaining the confidentiality of your account credentials, including passwords and OTPs
  • You must immediately notify KASHJET of any unauthorized access to or use of your account
  • You are liable for all activities conducted through your account, whether authorized or not
  • You must not share your account or credentials with any third party

6.2 Accuracy of Information

  • All information provided to KASHJET must be true, accurate, current, and complete
  • You must promptly update any changes to your personal, financial, or contact information
  • Providing false, misleading, or fraudulent information is a criminal offence and grounds for immediate account termination and legal action

6.3 Prohibited Activities

  • Using the Platform for any unlawful purpose or in violation of any applicable law
  • Submitting fraudulent, forged, or manipulated documents or information
  • Applying for loans using another person's identity or documents
  • Attempting to reverse-engineer, decompile, or extract source code from the Platform
  • Interfering with or disrupting the Platform's infrastructure, servers, or networks
  • Scraping, crawling, or automated data collection from the Platform
  • Circumventing or attempting to circumvent security features or access controls
  • Using the Platform to launder money or finance prohibited activities

7. Intellectual Property Rights

All content, features, functionality, design elements, trademarks, logos, trade names, software, algorithms, and proprietary technology on the Platform are owned by KASHJET Technologies Pvt. Ltd. or its licensors and are protected by Indian and international intellectual property laws.

You are granted a limited, non-exclusive, non-transferable, revocable licence to access and use the Platform for personal, non-commercial purposes. This licence does not include the right to: (a) modify, copy, or create derivative works based on the Platform; (b) use the Platform for commercial purposes; (c) remove any proprietary notices or labels; or (d) use any data mining, robots, or similar data gathering tools.

The KASHJET name, logo, and all related product and service names, design marks, and slogans are trademarks of KASHJET Technologies Pvt. Ltd. You may not use such marks without our prior written permission.

8. Disclaimers & Limitation of Liability

8.1 Platform Availability

  • The Platform is provided on an "AS IS" and "AS AVAILABLE" basis without warranties of any kind, either express or implied
  • KASHJET does not guarantee uninterrupted, timely, secure, or error-free operation of the Platform
  • Scheduled maintenance, system upgrades, and unforeseen technical issues may result in temporary service disruptions

8.2 Lending Decisions

  • KASHJET does not guarantee loan approval. All credit decisions are made solely by NBFC Partners based on their independent risk assessment
  • KASHJET is not liable for any loan rejection, delay in processing, or unfavorable terms offered by NBFC Partners
  • Interest rates, charges, and loan terms are determined by NBFC Partners and may vary based on borrower profile and market conditions

8.3 Limitation of Liability

  • To the maximum extent permitted by law, KASHJET's total liability for any claims arising from your use of the Platform shall not exceed the total processing fees paid by you in the 12 months preceding the claim
  • KASHJET shall not be liable for any indirect, incidental, special, consequential, or punitive damages
  • KASHJET shall not be liable for any loss arising from circumstances beyond our reasonable control (force majeure), including but not limited to natural disasters, government actions, pandemics, network failures, or banking system outages

9. Indemnification

You agree to indemnify, defend, and hold harmless KASHJET Technologies Pvt. Ltd., its directors, officers, employees, agents, affiliates, and NBFC Partners from and against any and all claims, damages, losses, liabilities, costs, and expenses (including reasonable attorney fees) arising from or related to: (a) your use of or access to the Platform; (b) your violation of these Terms; (c) your violation of any third-party rights; (d) any misrepresentation or fraud committed by you; or (e) your failure to repay any Credit Facility in accordance with the loan agreement.

10. Account Termination

10.1 Termination by You

  • You may request account closure at any time by contacting support@kashjet.in, provided you have no outstanding loan obligations
  • Account closure requests with outstanding loans will be processed only after full repayment of all dues

10.2 Termination by KASHJET

  • KASHJET reserves the right to suspend or terminate your account immediately, without prior notice, if we reasonably believe you have violated these Terms, engaged in fraudulent activity, or pose a risk to our platform or other users
  • Upon termination, your right to access and use the Platform ceases immediately
  • Termination does not relieve you of any outstanding financial obligations under active loan agreements
  • Data retention post-termination is governed by our Privacy Policy and applicable legal requirements

11. Dispute Resolution & Governing Law

These Terms shall be governed by and construed in accordance with the laws of India, without regard to conflict of law principles.

Any dispute, controversy, or claim arising out of or relating to these Terms or the use of the Platform shall first be attempted to be resolved through mutual negotiation and mediation. If the dispute remains unresolved within 30 days of the first written notice, it shall be referred to binding arbitration in accordance with the Arbitration and Conciliation Act, 1996 (as amended).

The arbitration shall be conducted by a sole arbitrator mutually appointed by the parties. The seat and venue of arbitration shall be Indore, Madhya Pradesh, India. The language of arbitration shall be English. The arbitral award shall be final and binding on both parties.

Subject to the above arbitration clause, the courts of Indore, Madhya Pradesh shall have exclusive jurisdiction over any proceedings relating to these Terms.

12. Regulatory Compliance

KASHJET operates in strict compliance with the following regulatory frameworks:

  • Reserve Bank of India (RBI) Digital Lending Guidelines, 2022
  • RBI Fair Practices Code for NBFCs
  • Information Technology Act, 2000 and associated rules
  • Digital Personal Data Protection Act, 2023
  • Prevention of Money Laundering Act, 2002 (PMLA)
  • Consumer Protection Act, 2019
  • Indian Contract Act, 1872
  • Credit Information Companies (Regulation) Act, 2005

13. Severability & Waiver

If any provision of these Terms is held to be invalid, illegal, or unenforceable by a court of competent jurisdiction, the remaining provisions shall continue in full force and effect. The invalid provision shall be modified to the minimum extent necessary to make it valid and enforceable.

The failure of KASHJET to enforce any right or provision of these Terms shall not constitute a waiver of such right or provision. Any waiver of any provision of these Terms will be effective only if in writing and signed by KASHJET.
